Secretary of State James Monroe on 20 October 1816, following the first meetings of the commission under article 4 of the Treaty of Ghent, charged with determining the boundary among the islands of Passamaquoddy Bay. ' The British constituted a formidable presence at St Andrews, New Brunswick, in that early autumn of 1816.

Private property was to be restored to its owners, although the matter of slaves created controversies later, and the international slave trade was to be abolished. There were several other problems to be worked out, the most difficult being Britain's insistence that its subjects retain the right to use the Mississippi (which had been part of the treaties of 1783 and 1794) and the American desire to retain the right to fish in certain inshore British North American waters and to cure their catches on certain areas of coastline (part of the treaty of 1783).

The French did not spell out in any detail the boundaries of the territory that they sold to the United States. This ambiguity, whether deliberate or not, led to decades of disagreement between the United States and its southern neighbours, Spain and later Mexico, over the extent of land acquired in the purchase - namely, about West Florida and Texas.
